Marine Charged with Killing Roommate Has First Appearance

A Marine charged with first degree murder made his first appearance in court Monday.

Javier Antonio Garzon, 21, is accused of stabbing David Jacob Rutherford, 24, to death at a residence on Parnell Drive in Hubert.

Garzon informed the court he intends to hire an attorney and is being held without bond at the Onslow County Detention Center.

Garzon is next scheduled to appear in court Sept. 17.

The men were roommates aboard New River Air Station, according to a Monday morning news release from Onslow County Sheriff’s Office (OCSO), and Garzon was house sitting for a friend who was out of town.

According to OCSO Maj. Chris Thomas, the homeowners were out of town and not involved in the stabbing.

A neighbor reported seeing the body in the backyard at 1:34 p.m. Sunday, according to the OCSO.

"Garzon and Rutherford had apparently been involved in an argument which escalated into the murder," according to the release.
